Google Kindly Wants to Pay Case Compensation, One User Gets IDR 77 Million

Jakarta, CNBC Indonesia - Google has stepped in to settle claims regarding cases of tracking users when using browser applications. The technology giant is required to pay at least a total of US$ 5 billion or the equivalent of Rp. 77 trillion.
Previously the plaintiffs alleged that Google's cookie analytics and applications tracked them while using the browser. Even though users have set Incognito mode for Chrome and other browsers with Private mode.
This action makes Google know some information about the user. Starting from friends, hobbies, favorite foods, shopping habits and other things online.
The lawsuit was filed in 2020. With the platform usage period starting June 1, 2016.
At that time the plaintiff asked for compensation worth US$ 5,000 (around Rp. 77 million) per user. The case was heard in the United States (US) District Court, Northern District of California.
Judge Yvonne Gonzales Rogers rejected Google's request to deny the lawsuit. According to him, the question remains whether the company has made a legally binding agreement not to collect data while browsing in private mode. He also cited Google's privacy policy and statements at the hearing. Namely related to limits on what information can be collected.
The latest report says lawyers for both parties agreed to a term sheet through mediation. Reuters noted that the terms of the settlement were not disclosed, quoted on Saturday (13/1/2024).
A formal settlement will likely be presented to the court for approval. It is estimated that this will be done on February 24, 2024. Rogers also postponed the lawsuit hearing scheduled for February 5, 2024 after the settlement.

- Google turun tangan untuk menyelesaikan tuntutan perihal kasus pelacakan pengguna saat menggunakan aplikasi browser. Adapun raksasa teknologi itu diharuskan membayar setidaknya total US$ 5 miliar atau setara Rp 77 triliun.
Sebelumnya penggugat menuding bahwa analitik cookie dan aplikasi Google melacak mereka saat menggunakan browser. Padahal para pengguna telah menyetel ke mode Incognito untuk Chrome dan browser lain dengan mode Private.
Tindakan itu membuat Google mengetahui beberapa informasi soal pengguna. Mulai dari teman, hobi, makanan favorit, kebiasaan belanja dan hal lain secara online.
Tuntutan itu diajukan pada 2020 lalu. Dengan periode penggunaan platform sejak 1 Juni 2016.
Saat itu pihak penggugat meminta ganti rugi senilai US$ 5.000 (sekitar Rp 77 juta) per pengguna. Kasusnya digelar di Pengadilan Distrik Amerika Serikat (AS), Distrik Utara California.
Hakim Yvonne Gonzales Rogers sempat menolak permintaan Google membantah gugatan tersebut. Menurutnya masih jadi pertanyaan apakah perusahaan membuat perjanjian mengikat secara hukum untuk tidak mengumpulkan data selama browsing dengan mode private.
Dia juga mengutip kebijakan privasi dan pernyataan dari Google saat persidangan. Yakni terkait batasan informasi apa yang bisa dikumpulkan.
Laporan terbaru mengatakan pengacara kedua belah pihak menyetujui adanya lembar persyaratan lewat mediasi. Reuters mencatat tidak diungkapkan persyaratan penyelesaian itu, dikutip Sabtu (13/1/2024). Penyelesaian formal kemungkinan akan diberikan pada pengadilan untuk mendapatkan persetujuan. Diperkirakan ini dilakukan pada 24 Februari 2024. Rogers juga menunda sidang gugatan yang dijadwalkan 5 Februari 2024 setelah adanya penyelesaian tersebut.
