Mutual Report Action Regarding Al Zaytun Islamic Boarding School at Bareskrim
The polemic that occurred at the Al Zaytun Islamic Boarding School (Ponpes) seized the public's attention. Al Zaytun Islamic Boarding School is considered to have committed a number of controversial things because it is contrary to Islamic teachings and is suspected of having committed a crime.
In fact, the Coordinating Minister for Politics, Law and Security (Menko Polhukam) Mahfud MD said the crime that occurred at the Al Zaytun Islamic Boarding School was very clear.
Mahfud also asked the National Police to take action regarding the Al Zaytun Islamic Boarding School. The National Police's Criminal Investigation Agency (Bareskrim) has moved to investigate the alleged crime that occurred at the Al Zaytun Islamic Boarding School.
On Friday (23/6/2023) evening, a report against the Al Zaytun Islamic Boarding School appeared. The Pancasila Defenders Advocate Forum (FAPP) reported the leadership of the Al Zaytun Panji Gumilang Islamic Boarding School to Bareskrim for alleged blasphemy.
Since then, Bareskrim has acted by processing incoming police reports (LP). The police began to examine the reporting witnesses to expert witnesses.
However, after the first report appeared, other parties joined in making an LP to the National Police Criminal Investigation Unit. Reporting action related to the Al Zaytun Islamic Boarding School also occurred.
NII Crisis Center founder reports Panji Gumilang
The founder of the Islamic State of Indonesia (NII) Crisis Center Ken Setiawan reported the leadership of Al Zaytun Panji Gumilang Islamic Boarding School to Bareskrim Polri for alleged blasphemy.
Ken's report was registered in a police report (LP) numbered LP/B/169/VI/2023/SPKT/BARESKRIM POLRI dated June 27 2023. Panji is said to have allegedly violated Article 156 A of the Criminal Code concerning Blasphemy of Religion.
"Yes, thank God we reported Panji Gumilang regarding religious blasphemy," Ken said when met at the National Police Headquarters, Jakarta, Tuesday (27/6/2023).
Ken hopes that this step can stop Panji Gumilang's steps, which he calls spreading the heretical ideology of the Islamic State of Indonesia (NII).
He also appreciated the Indonesian government, in this case the Vice President (Wapres) Ma'ruf Amin and the Coordinating Minister for Political, Legal and Security Affairs Mahfud MD, for encouraging cases to be resolved quickly.
"We hope that with this action, this can be suppressed and the problem can be resolved quickly," said Ken.
Ken reported back
As many as 113 guardians of Al Zaytun Islamic Boarding School students reported Ken Setiawan to Bareskrim. Ken was reported on suspicion of defamation, fake news, and news that caused a commotion.
Ken was not alone in being reported to the police. His friend, Herri Pras, was also reported in the same police report (LP).
As for reports from the guardians of the Al Zaytun Islamic Boarding School students, they were registered in a police report (LP) numbered LP/B/168/VI/2023/SPKT/BARESKRIM POLRI dated June 27 2023.
Ken and Herri were reported to the police for allegedly violating Article 311 of the Criminal Code, Article 27 Paragraph 3 of Law Number 19 of 2016 concerning Amendments to Law Number 11 of 2008 concerning Information and Electronic Transactions (ITE), Article 14 Paragraph 1 of Law Number 19 of 2016 concerning Amendments On Law Number 11 of 2008about ITEs.
"(Reporting) Ken Setiawan and Herri Pras," said the attorney for the guardians of the Al Zaytun Islamic Boarding School students Sukanto when met at the Bareskrim Building, Jakarta, Tuesday (27/6/2023).
Sukanto said that his party had reported Ken and Herri for the content they had created and broadcast.
The reason is that the contents of the content are said to accuse Al Zaytun Islamic Boarding School of allowing adultery, but the sin must be redeemed by paying Rp. 2 million.
"With a ransom of Rp. 2 million, his sins are said to be gone. That is not true, that is fake news," said Sukanto.
According to him, the content was uploaded by Ken and Herri on their respective YouTube accounts on May 22, 2023.
Bareskrim accepts all incoming reports
Bareskrim Polri said it was ready to receive all reports related to alleged criminal acts at the Al Zaytun Islamic Boarding School, Indramayu, West Java.
At that time, the head of Bareskrim Polri, Komjen Agus Andrianto, said that his party had coordinated with the Coordinating Minister for Political, Legal and Security Affairs (Menko Polhukam) Mahfud MD.
"We are ready to receive reports on the activities of the Al Zaytun Islamic Boarding School which are suspected of committing blasphemy, we will handle it from there later," Agus said on the sidelines of the fun walk for Bhayangkara's 77th anniversary at the National Monument (Monas), Central Jakarta on 25 June 2023.
Agus also stated that his staff did not rule out summoning the Al Zaytun Islamic Boarding School and witnesses.
"Later we will complete it with witness statements, we will ask for information from the MUI. Then if there is an element of religious blasphemy, the process will definitely be continued," said Agus.
Aksi Saling Lapor Terkait Ponpes Al Zaytun di Bareskrim
Polemik yang terjadi di Pondok Pesantren (Ponpes) Al Zaytun menyita perhatian publik. Ponpes Al Zaytun dianggap melakukan sejumlah hal yang kontroversial karena bertentangan dengan ajaran Islam hingga diduga melakukan tindak pidana.
Bahkan, Menteri Koordinator Bidang Politik, Hukum, dan Keamanan (Menko Polhukam) Mahfud MD menyebut tindak pidana yang terjadi di Ponpes Al Zaytun sangat jelas.
Mahfud pun meminta agar Polri melakukan tindakan terkait Ponpes Al Zaytun. Badan Reserse Kriminal (Bareskrim) Polri telah bergerak untuk mengusut dugaan tindak pidana yang terjadi di Ponpes Al Zaytun.
Pada Jumat (23/6/2023) malam, laporan terhadap Ponpes Al Zaytun muncul. Forum Advokat Pembela Pancasila (FAPP) melaporkan pimpinan Ponpes Al Zaytun Panji Gumilang ke Bareskrim atas dugaan penistaan agama.
Sejak itu, Bareskrim bertindak dengan memproses laporan polisi (LP) yang masuk. Kepolisian mulai memeriksa saksi pelapor hingga saksi ahli.
Namun, setelah laporan pertama muncul, pihak-pihak lain ikut membuat LP ke Bareskrim Polri. Aksi saling lapor terkait Ponpes Al Zaytun pun terjadi.
Pendiri NII Crisis Center laporkan Panji Gumilang
Pendiri Negara Islam Indonesia (NII) Crisis Center Ken Setiawan melaporkan pimpinan Ponpes Al Zaytun Panji Gumilang ke Bareskrim Polri atas dugaan penistaan agama.
Laporan Ken itu teregister dalam laporan polisi (LP) bernomor LP/B/169/VI/2023/SPKT/BARESKRIM POLRI tertanggal 27 Juni 2023. Panji disebut diduga melanggar Pasal 156 A KUHP tentang Penistaan Agama.
"Iya alhamdulillah tadi kita sudah melaporkan Panji Gumilang terkait dengan penodaan agama," ujar Ken saat ditemui di Mabes Polri, Jakarta, Selasa (27/6/2023).
Ken berharap, langkahnya ini bisa menghentikan langkah Panji Gumilang yang disebutnya menyebarkan paham sesat Negara Islam Indonesia (NII).
Ia juga mengapresiasi pemerintah Indonesia, dalam hal ini Wakil Presiden (Wapres) Ma'ruf Amin dan Menko Polhukam Mahfud MD, yang mendorong kasus cepat diselesaikan.
"Kita berharap dengan penindakan ini, ini bisa diredam dan persoalan bisa cepat selesai," kata Ken.
Ken dilaporkan balik
Sebanyak 113 wali santri Ponpes Al Zaytun melaporkan Ken Setiawan ke Bareskrim. Ken dilaporkan atas dugaan pencemaran nama baik, berita bohong, dan pemberitaan yang menimbulkan keonaran.
Ken tidak sendirian dilaporkan ke polisi. Temannya, Herri Pras, juga dilaporkan dalam laporan polisi (LP) yang sama.
Adapun laporan para wali santri Ponpes Al Zaytun teregister dalam laporan polisi (LP) bernomor LP/B/168/VI/2023/SPKT/BARESKRIM POLRI tertanggal 27 Juni 2023.
Ken dan Herri dilaporkan ke polisi karena diduga melanggar Pasal 311 KUHP, Pasal 27 Ayat 3 UU Nomor 19 Tahun 2016 tentang Perubahan Atas UU Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik (ITE), Pasal 14 Ayat 1 UU Nomor 19 Tahun 2016 tentang Perubahan Atas UU Nomor 11 Tahun 2008 tentang ITE.
"(Melaporkan) Ken Setiawan dan Herri Pras," ujar kuasa hukum para wali santri Ponpes Al Zaytun Sukanto saat ditemui di Gedung Bareskrim, Jakarta, Selasa (27/6/2023).
Sukanto mengatakan, pihaknya melaporkan Ken dan Herri atas konten yang telah mereka buat dan tayangkan.
Pasalnya, isi konten tersebut dikatakan menuding Ponpes Al Zaytun memperbolehkan zinah, tetapi dosanya harus ditebus dengan membayar Rp 2 juta.
"Dengan tebusan Rp 2 juta itu dosanya katanya hilang. Itu tidak benar, itu berita bohong," kata Sukanto.
Menurutnya, konten tersebut diunggah oleh Ken dan Herri di akun YouTube milik mereka masing-masing pada 22 Mei 2023 lalu.
Bareskrim terima semua laporan yang masuk
Bareskrim Polri menyatakan siap menerima seluruh laporan terkait dugaan tindak pidana di Ponpes Al Zaytun, Indramayu, Jawa Barat.
Kepala Bareskrim Polri saat itu, Komjen Agus Andrianto mengatakan bahwa pihaknya telah berkoordinasi dengan Menteri Koordinator Bidang Politik, Hukum, dan Keamanan (Menko Polhukam) Mahfud MD.
“Kami siap untuk menerima laporan terhadap aktivitas Pondok Pesantren Al Zaytun yang diduga melakukan penistaan agama, nanti kami akan tangani dari sana,” kata Agus di sela-sela fun walk HUT ke-77 Bhayangkara di Monumen Nasional (Monas), Jakarta Pusat pada 25 Juni 2023.
Agus juga menyatakan bahwa jajarannya tidak menutup kemungkinan memanggil pihak Ponpes Al Zaytun dan saksi-saksi.
“Nanti kami akan lengkapi dengan keterangan saksi, kami akan minta keterangan dari MUI. Kemudian kalau memang ada unsur penistaan agama pasti akan proses lanjut,” ujar Agus.
