Jokowi Orders to Follow the Rules regarding Endar, These are the KPK Rules regarding the Repatriation of Employees






President Joko Widodo (Jokowi) asked that the transfer affairs of Brigadier General Endar Priantoro at the KPK follow the rules. The mechanism at the KPK requires that the repatriation of employees must be based on clear reasons, namely 'serious violations'. 

Viewed by detikcom, Wednesday (5/4/2023), the rules regarding the repatriation of KPK employees to the main agency are contained in the Corruption Eradication Commission of the Republic of Indonesia Number 1 of 2022 concerning the Staffing of the Corruption Eradication Commission which was signed by Firli. 

In the Perkom, the KPK can request or accept assignments from civil servants and members of the National Police. This is regulated in Article 3 paragraph 2 of the KPK Regulations. Here are the contents:

Article 3

(1) Commission staff consists of:
a. Civil servants: and
b. PPPK. 

(2) If it is necessary to strengthen the duties and functions of the organization, the Commission may request and accept assignments from civil servants and members of the Indonesian National Police in accordance with the provisions of the laws and regulations. 

The KPK regulation also regulates the affairs of returning KPK employees to their parent agencies. The following is the contents of the article:

Article 30

Commission employees as referred to in Article 3 paragraph (2) are returned to the parent agency if they are legally proven to have committed a serious disciplinary violation

The KPK removed Endar from the position of Director of Investigation on the grounds that his term of office with the National Police ended on March 31, 2023. This removal then caused a polemic because the National Police Chief had extended Endar's tenure at the KPK in a letter to the KPK leadership dated March 29, 2023. 

The National Police Chief has also returned to reply to Endar's return letter to the National Police sent by the Corruption Eradication Commission. In the letter, the National Police Chief again requested that Endar remain on duty at the KPK. 

Endar has also reported this polemic to the KPK Supervisory Board. He hopes Dewas can resolve the polemic that occurred. 

The KPK then opened its voice. The KPK confirmed that the removal was carried out because Endar's term of office ended on March 31, 2023. The KPK also stated that it did not propose to extend Endar's term of office, but instead recommended that Endar get a promotion at the National Police. 

President Jokowi Asks to Follow the Rules
President Jokowi also spoke about the polemic on the removal of Brigadier General Endar from the KPK's Director of Investigation. Jokowi asked that employee transfers not create a commotion. 

"We hope that the mutation or transfer will not cause a commotion. There are rules for everything," Jokowi said at Pasar Johar Baru, Central Jakarta, Wednesday (5/4/2023). 

Jokowi said each institution has its own mechanism and rules. He asked that all parties follow the rules. 

"In every institution, we have to know, yes, in every institution there is a mechanism. There are rules, SOPs, everything is there. So just follow that," he said.
